ATTORNEYS & PURCHASE CONTRACTS IN CONNECTICUT

Customs for purchase contract formats and attorney involvement vary in the different regions of our state.   In the southerly portion of the state, binders are most typically written by agents (essentially memorandums of agreement or heavily watered down purchase agreements) to be replaced soon after with attorney written contracts.     In the northerly portion of our state, contracts are written by the agents and later reviewed and executed by attorneys.    In either situation, the attorney is an important team member and should be ready to assist the client and the agent as needed to support the safety and clarity of the purchase process.    The attorney will search the title, manage the closing and guard the performance of the contract but may also review the contract prior to signing and may participate in negotiation of transaction issues.      This is different with each transaction and varies with issues encountered, attorney style, customs in the particular location and preferences of the buyer. 

All contract forms must conform to state law and are equally legal statewide.    Depending on the  circumstances, one form or another might better serve our client's interest regardless of location.  Our broad experience with most all contract types across the regions of our state is of significant benefit to our clients.   

Although we are not aware of the existence of any CT law firm that specializes solely in real estate, there are many attorneys that include real estate in their practices.    We find that depending on which area of the state they work in, they may not be familiar with some contract customs or protocols in all regions of the state.    If you have your own attorney who is not familiar with the contract customs of the specific area you are buying in or not familiar with a contract type you may have selected to use,  we will help familiarize your attorney with it.     Alternatively we can, at your request,  refer you to a local attorney previously experienced with it.   

Because we are not attorneys, we will rely, and caution our clients to rely, on their attorney for resolution of issues of a legal nature.  We work closely with the attorney should special issues arise during the fulfillment of your transaction.     We bring an attitude of ego-free cooperation  to the table, which we believe serves to promote the best work from all involved and best results for our clients.
